Notice of Intent to Remove Mural & Mosaic

FAIR OAKS RECREATION AND PARK DISTRICT  |  NOTICE OF INTENT TO REMOVE MURAL AND MOSAIC IN PLAZA PARK RENOVATION WORK

The Fair Oaks Recreation & Park District (“District”) plans to renovate the Veterans Memorial Amphitheater in Plaza Park, Fair Oaks, CA, which is set to begin February 1, 2021. There is a mural located on the back side of the Amphitheater and a rock mosaic located near the center of Plaza Park, which were created by local artist Hugh Gorman. The Amphitheater and park renovation work requires the removal of both the mural and mosaic. The District has determined that the mural and mosaic cannot be removed without the risk of damage or destruction, and accordingly does not assume the obligation of either removal of the artwork or the cost of removal.

The District gives notice to the general public and interested entities of its intent to remove both the mural and the mosaic before the renovations. 

The California Art Preservation Act (Cal. Civil Code sections 987 & 989) and the Federal Visual Artist Rights Act of 1990 (17 U.S.C. sections 101, 106A, 113, & 301) protect the public’s moral rights and interests in the physical integrity of certain works of art after incorporation into another building. If there is any entity or individual interested removing either or both the mural and mosaic pursuant to these acts may do so at its own costs. Any entity or individual that would like to remove the mural or mosaic must inform the District of its intent to do so in writing within 30 days of the date of this notice. The interested entity or individual would be required to remove the mural and/or mosaic before the District’s planned renovations commence on February 1, 2021.
